Patient Protection and Affordable Care Act of 2010 Section 4205
In March of 2010, the President signed the Patient Protection and Affordable Care Act of 2010. Section 4205 of this legislation requires and similar retail food establishments with 20 or more locations to list calorie content information for standard menu items on restaurant menus and menu boards, including drive-through menu boards. Restaurants are also required to have other nutrition information available – total calories, fat, saturated fat, cholesterol, sodium, total carbohydrates, sugars, fiber and total protein. In addition, restaurants must have calorie information on their menus along with a statement regarding calorie intake.
Restaurants With Fewer Than 20 Locations
The Food and Drug Administration (FDA) has set up a voluntary menu labeling program for restaurants with fewer than 20 locations. Restaurants who register will not be subject to any state or local menu labeling requirements.
